In these terms and conditions Bathtime Creations Limited  is referred to as ‘the supplier’ and the person company organisation or other body is referred to as ‘the customer’.

 

1.             All terms and conditions of the contract between the supplier and the customer are contained in this document.  No variation of this contract shall bind either party, unless made in writing and signed by both parties.

 

2.            The total contract price detailed on this order shall remain fixed and will not be subject to any surcharge provided that:

 

(i)                 The labour and parts are strictly limited to that detailed on a quotation approved by the customer.

 

(ii)               The supplier is not prevented by circumstances or conditions within the controls or responsibility of the customer from completing the delivery within a period of six months of the date of this contract.  Thereafter the supplier reserves the right to pass on any price increase or expenses arising between order and delivery dates.

 

(iii)             Any amendments to this order are made within seven days of the date of this order.  No cancellation or amendments can be accepted thereafter.  Any amendments made after seven days will be subject to a handling charge of not more than 35% of the item or items amended.

 

(iv)             The payment terms detailed on this order have been adhered to.

 

3.            Payment terms:

 

                All bathroom installations require a 35% deposit with order confirmation and final 65% upon completion.

 

4.            Products:

 

                Illustrations in catalogues, sales literature and advertisements and any preliminary specifications, drawings, dimensions are intended as a guide only.  They may be accurate but are not binding upon us in any way and we reserve the right to withdraw products or models as they may be superseded by improved or amended designs from time to time.  Any sample or model shown by the supplier is intended to illustrate a typical example of the supplier’s products and materials used.  The goods supplied to the customer may not necessarily be identical to the sample or demonstration model shown, as the supplier is engaged in continuous design and development, and reserves the right to supply to modified specification.  The supplier endeavours to ensure uniformity of colour in all goods supplied but the customer accepts that in the use of both natural and synthetic materials slight colour variations may be unavoidable.  The supplier reserves the right to substitute an alternative product in consultation with the customer.

 

5.            Installation:

 

(i)                 Should the supplier undertake to include installation in the contract no responsibility can be accepted for uneven floors, walls or ceilings.  The supplier is also not responsible for the condition of old units which are removed of for damage to wall tiles and floor coverings which may occur during removal.

 

(ii)               Unless specifically detailed on the order, site clearance of old units and other debris shall be the responsibility of the customer.

 

(iii)             Choice of materials used in the product and installation shall be determined by the supplier.

 

(iv)             Security of materials left on site of a part completed installation shall be the responsibility of the customer who shall be liable for any theft, accidental, malicious or negligent damage.

 

(v)               Payment for installation shall be made upon final completion (the due date).  Where the customer is to obtain a private loan through a bank, building society or other such body, it is the customer’s responsibility to ensure the balance is paid on the due date.

 

(vi)             Final completion (the due date) shall be defined as the day on which all scheduled materials have been delivered and on which all major scheduled work has been completed.  Completion of additional work required by the customer or minor alterations or adjustments, or work to be carried out under guarantee do not constitute a valid reason for not completing the final payments as agreed.

 

6.            Guarantee:

 

(i)                 The supplier will rectify any fault or faults developing due to defective products and/or installation within the guarantee period of one year, provided all balances have been paid.  The guarantee is effective for one year from final completion (the due date) and does not cover labour charges or defects arising from fair wear and tear, accident, neglect or abuse.

 

(ii)          If the particular range, colour or material is no longer available to the supplier they will use their best endeavours to provide a suitable alternative for the defective articles and the customer shall be bound to accept such an alternative.
